These Terms & Conditions govern your use of AURUM and the website aurumcoinsandbullion.com. Please read them carefully. By using the Site, you agree to be bound by these Terms, without prejudice to your statutory consumer rights.
About These Terms
These Terms & Conditions (these “Terms”) govern your access to and use of the website aurumcoinsandbullion.com (the “Site”) and the products and services offered through it by AURUM (the “House”, “we”, “us”, “our”). By browsing the Site, creating an account, placing an order, making an offer, bidding in an auction, or otherwise using our services, you agree to these Terms. Nothing in these Terms excludes, restricts or modifies any statutory consumer rights you may have under applicable mandatory law, including the consumer-protection laws of Cyprus and, where you are resident in another EU/EEA jurisdiction, the mandatory protections of that jurisdiction. Where any provision of these Terms is found to be unenforceable in respect of a consumer, it will apply only to the maximum extent permitted by law.
Eligibility & Accounts
To use certain features of the Site you may create an account. You agree to provide accurate, current and complete information when creating and maintaining your account, and to keep your account details up to date. You are responsible for keeping your account sign-in credentials secure and for activity carried out through your account. If you become aware of any unauthorised use of your account, you should contact us promptly. We will not hold you responsible for a security incident that occurs through no fault of your own and outside your reasonable control. Where offered, you may sign in using Google Sign-In, which authenticates you through Google; your use of Google Sign-In is also subject to Google’s applicable terms. We may use the basic account information made available through that authentication to identify or create your AURUM account. You must not misuse the Site, including by engaging in fraud, providing false information, attempting unauthorised access, manipulating auctions, offers or prices, or any other unlawful activity. We may restrict, suspend or close an account where reasonably necessary for legitimate security, fraud-prevention, legal-compliance or protective reasons, without prejudice to any rights you may have under applicable law.
Products
AURUM sells collectible coins, numismatic products, precious-metal coins, bullion, bars and related collectible items through the Site. We aim to present product descriptions, photographs, specifications, metal content, weight, fineness, condition, mintage and other product information as accurately as reasonably possible. Unless a listing expressly states that the photograph shows the exact item you will receive, a photograph may be a representative example of the product; the individual listing description controls what is included and the condition of the item. We reserve the right to correct genuine typographical or listing errors, subject to applicable consumer law. Where an error has led to an incorrect price or description, we will address it in accordance with applicable law, including, where required, by contacting you before proceeding or cancelling the affected order with a full refund.
Precious-Metal Prices & Market Information
Gold, silver, platinum and palladium prices that may be displayed on the Site can be supplied by third-party market-data providers and are provided for general information only unless expressly incorporated into the price of a specific product. Market prices for precious metals can change rapidly and may differ from the price quoted at the point of purchase. The price applicable to a purchase is the price displayed and confirmed during the applicable order and checkout process, subject to the correction of genuine errors where permitted by law. AURUM does not provide investment advice, and nothing on the Site constitutes a guarantee of future value or returns. The market value of collectible and precious-metal products may rise as well as fall, and past performance does not guarantee future value.
Product Availability
All products are subject to availability. Placing an item in your cart does not by itself reserve that item or guarantee its availability. An item is reserved or allocated only according to the actual AURUM checkout and stock-reservation process that applies to your purchase. The details of that process are governed by the Site’s checkout logic and the rules in effect at the time of purchase. Where an item becomes unavailable because of a genuine stock error or other exceptional circumstance, we may cancel the affected transaction and refund any amount already paid, to the extent permitted by applicable law.
Orders
Submitting an order through the Site constitutes your offer to purchase the selected items at the price and on the terms displayed at checkout. Order submission, payment, order confirmation and acceptance/fulfilment are distinct stages. An order is generally accepted when we (or our systems) confirm it following payment in accordance with the checkout and order process; payment itself does not necessarily constitute acceptance where the checkout process requires further confirmation. AURUM may refuse or cancel an order, in whole or in part, where reasonably necessary because of: payment failure or decline; suspected fraud or unauthorised activity; a genuine stock error; an obvious pricing or listing error; a legal or regulatory restriction; or an inability to fulfil the order. Any refund arising from such a cancellation will be handled in accordance with applicable law and the payment method used.
Prices
Prices for products are displayed in the currency shown on the Site. Applicable taxes are handled according to the checkout and order configuration in effect at the time of purchase. Shipping costs and any applicable payment-related charges are displayed before you confirm your purchase, and the final amount payable is shown to you before payment. We do not represent that any particular tax treatment or exemption applies to your transaction unless expressly stated; tax and duty obligations may depend on your location and applicable law.
Payment
The payment methods available to you are those displayed at checkout. AURUM integrates third-party payment providers, including Stripe and PayPal where enabled, to process card and wallet payments. Payment processing is subject to the relevant provider’s systems, terms and policies. Where other payment methods, such as bank transfer or payment upon delivery, are enabled, their specific conditions and any requirements are displayed during checkout. AURUM does not guarantee the availability of any particular payment method, which may depend on your location, the provider, and the configuration in effect at the time.
PayPal Handling Fee
Where a PayPal handling fee is applied by the live checkout configuration, an additional PayPal-related handling or payment charge may apply to transactions completed using PayPal. The exact charge, where applicable, is clearly displayed to you before you confirm payment, and the checkout amount shown to you at the time of payment is authoritative for the transaction. We do not bind ourselves to any specific fee amount in these Terms; the fee, if any, is determined by the checkout configuration in effect at the time of purchase and shown to you before payment.
Shipping & Delivery
Available shipping methods and their costs are displayed during checkout according to your delivery destination. Estimated delivery times are estimates only and are not guaranteed unless expressly stated for your order. Delays caused by postal operators, couriers, customs authorities, or events outside our reasonable control may occur. You are responsible for providing accurate and complete delivery information. Tracking information may be supplied where available. Further information about shipping and collection is available on our Shipping & Pickup page; in the event of any inconsistency, the terms applicable to your order are those confirmed at checkout and these Terms.
International Orders, Customs & Import Charges
For international orders, customs procedures, import restrictions, duties, taxes or other charges may apply depending on the destination. You may be responsible for charges imposed separately by the customs or tax authorities of the destination country or by the carrier, to the extent permitted by applicable law. Where a charge is collected by AURUM at checkout, it will be displayed before you confirm your purchase. AURUM is responsible for charges it is legally required to collect itself; any additional charges imposed by destination-country authorities or carriers are separate from amounts collected by us at checkout.
Authenticity
AURUM is committed to accurately describing and selling authentic items. Where a product is issued with a certificate, case, packaging, serial number or other accessories, the individual product description determines what is included with that product. We do not promise that every product includes a certificate or original packaging unless so stated in its listing. Condition, Images & Numismatic Products
Collectible coins can vary individually. Unless a recognised third-party grading company’s grade is explicitly stated for a product, condition descriptions represent our reasonable assessment and may involve professional judgement. Photographs may in some cases show the actual item and in other cases a representative example; the individual listing description controls. We do not use this section to exclude liability for materially inaccurate descriptions, which remain subject to applicable law.
Offers
Where a product is eligible, you may submit an offer at a price you propose. AURUM may accept, decline or counter your offer, and offers may expire if not acted on within the period shown. When an offer is accepted (by us or, for a seller-initiated offer or counter, by you), an accepted offer amount is recorded and you may complete the purchase through the Site’s checkout at that accepted amount. Acceptance of an offer creates the opportunity to complete the purchase through the checkout process; it does not by itself transfer ownership, and stock remains subject to the Site’s reservation and purchase rules. Offers are rate-limited to protect the integrity of the system. Misuse of the offer system, including submitting offers in bad faith or to manipulate availability or pricing, may result in restrictions on your account, subject to applicable law.
Auctions & Bidding
Where a product is offered by auction, bidding is conducted through the Site’s auction functionality. To bid you must meet any eligibility requirements indicated on the Site, and all bids must be genuine. Where enabled, proxy or maximum bidding places bids on your behalf up to your stated maximum, and minimum bid increments may apply as shown. An auction closes at its stated end time. The highest valid bid that meets any applicable reserve determines the winning bidder. AURUM may cancel bids that are fraudulent, manipulative, or the result of technical error, and may correct technical errors where legally permissible. If you are the winning bidder, an order is created for you for the winning amount and you will be asked to complete payment within the payment deadline shown, where one is configured. If payment is not completed within any configured deadline, the auction may be treated as overdue and, where supported by the system, the order may be cancelled or, in appropriate cases, offered to the next valid bidder, in accordance with applicable law. No buyer’s premium, auction fee, reserve or penalty applies unless expressly stated for the auction. A winning bid creates an obligation to complete payment for the order created on your account, subject to your statutory rights.
Presales / Pre-Orders
Some products may be offered before their expected release or availability (presales). Expected release or delivery dates for presale products are estimates where appropriate and may be affected by mint, issuer or manufacturer delays. Where a material delay occurs, it will be handled in accordance with applicable consumer law, including any statutory cancellation or refund rights you may have. Individual product listings may provide specific presale information, which should be read together with these Terms. We do not provide for indefinite delay and nothing in this section removes any statutory cancellation or refund rights you may have.
Cancellations, Returns & Refunds
Consumers purchasing through AURUM may exercise a right of withdrawal within 14 days of receiving their order where the statutory right of withdrawal applies under applicable consumer law. To exercise this right, the customer should contact AURUM at info@aurumcoinsandbullion.com within the applicable 14-day period and clearly state that they wish to withdraw from the purchase. Returned items should be returned in the condition in which they were received, subject to the customer’s statutory right to inspect the goods to the extent permitted by law. Customers may be responsible for direct return shipping costs where permitted by applicable law. Certain products or transactions may be excluded from the statutory right of withdrawal where an exception under applicable consumer law applies. This may include, where legally applicable, goods whose price depends on fluctuations in financial markets that AURUM cannot control. AURUM does not treat all bullion, gold, silver, coins or precious-metal products as automatically excluded; an exception applies only where the legal requirements for that exception are satisfied. Online auction purchases are not automatically excluded from the 14-day withdrawal right. Where an auction transaction legally qualifies for an applicable statutory exception, that exception may apply; otherwise the customer’s applicable statutory consumer rights remain unaffected. Nothing in these Terms limits a customer’s statutory rights where goods are faulty, damaged, incorrect or materially not as described. Refunds approved following a valid withdrawal or other statutory remedy will be processed in accordance with applicable law and the relevant payment method.
Refunds
Approved refunds are generally returned through the original or applicable payment method where supported. Processing times depend on the payment provider and your bank and may take longer than the time it takes us to initiate the refund. We do not guarantee a specific bank processing time for refunds, as this is outside our control.
Intellectual Property
The AURUM branding, website design, text, graphics and other proprietary site content are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute or otherwise exploit AURUM’s proprietary site content without our prior written permission, except as permitted by law. We do not claim ownership of third-party trademarks, mint artwork, coin designs or other third-party intellectual property, which remain the property of their respective owners. All third-party marks and designs are referenced for identification and descriptive purposes only.
Acceptable Use
You agree not to: use the Site for any fraudulent or unlawful purpose; attempt to gain unauthorised access to the Site, its systems or another user’s account; interfere with or disrupt the Site or its operation; use automated means to access or collect data from the Site in a manner that is excessive or harmful; manipulate auctions, bids or offers; impersonate another person or entity; or assist any third party in doing any of the foregoing. We may take reasonable measures, including restricting or suspending access, to prevent abuse and protect the Site and its users, subject to applicable law.
Third-Party Services
The Site relies on third-party services such as payment processors, delivery providers, authentication providers and infrastructure providers. These services are governed by their own applicable terms and policies, and their availability and performance are not entirely within our control. We are not responsible for the acts or omissions of third-party service providers except to the extent required by applicable law.
Service Availability
We aim to maintain the availability of the Site but do not guarantee uninterrupted or error-free operation. Maintenance, updates, technical problems or events outside our reasonable control may temporarily affect the availability or performance of the Site. Nothing in this section excludes liability that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, and without affecting any statutory consumer rights, AURUM’s liability for any single claim arising in connection with the Site or your purchases is limited to the amount you paid for the relevant order, except where a higher liability is required by law. Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; defective products under applicable law; or any other liability that cannot lawfully be excluded or limited. These Terms do not affect any statutory consumer rights you may have under the law of Cyprus or, where you reside in another EU/EEA jurisdiction, the mandatory protections of that jurisdiction.
Force Majeure / Events Outside Reasonable Control
We are not responsible for delays or failures to perform that are caused by circumstances outside our reasonable control, including acts of God, natural events, postal or courier disruption, customs actions, government measures, or failures of third-party providers. Where a delay or failure is caused by such circumstances, we will take reasonable steps to resume performance as soon as reasonably practicable, subject to your statutory rights.
Privacy
Processing of your personal data in connection with the Site is governed by our Privacy Policy, available at https://aurumcoinsandbullion.com/privacy-policy. Please review that policy for information about how we collect, use and protect your personal information and the rights you have in relation to it.
Changes to These Terms
We may update these Terms from time to time. Changes apply prospectively from the “Last updated” date shown on this page and do not retroactively alter transactions already completed under the previous version. Where material changes are required by law to be communicated, we will do so in the manner required. We encourage you to review this page periodically. Continued use of the Site after a change takes effect constitutes acceptance of the updated Terms, without prejudice to your statutory rights.
Governing Law & Consumer Rights
These Terms and any dispute arising in connection with the Site or your purchases are governed by the laws of the Republic of Cyprus, without prejudice to any mandatory consumer-protection rights you may have under the law of the EU/EEA jurisdiction in which you reside. For consumers, nothing in this section deprives you of the protection afforded by the mandatory provisions of the law of the country where you have your habitual residence, to the extent that protection cannot be derogated from by contract. Any dispute may, where applicable, be brought before the competent court of the jurisdiction in which you reside, or before the courts of Cyprus, as provided by applicable law.
